1. Introduction
1.1. These terms and conditions (together with any documentation referred to herein) (the "Terms") govern the use of the website located at www.studentvolunteer.ie (the "Site") and any information made available on the Site. The Site is operated by the University Of Limerick together with the applicable participating higher education institutions, details of which are made available on the Site (the "Participating Institutions") (together "us", "we" or "our") and these Terms set out the rights and obligations of all users ("you"/"your") in relation to your use of the Site. If you are accessing and using the Site on behalf of a company (such as your employer) or other legal entity, you represent and warrant that you have the authority to bind that company or other legal entity to these Terms. In that case, “you” and “your” will refer to that company or other legal entity
1.2. Please read carefully these Terms and our Privacy Statement and Cookies Policy. Please note that for the purposes of the Data Protection Acts 1988 and 2003 (the "Acts") the applicable Participating Institution will be the data controller in respect of any personal data collected via the Site.
2. Acceptance of Terms
2.1. By using any part of the Site and/or accepting the Terms of Use, you signify acceptance of these Terms, our Privacy Statement and our Cookies Policy. If you do not agree with or you are not comfortable with any aspect of these Terms, the Privacy Statement and/or the Cookie Policy, please do not use the Site.
2.2. We may revise the Terms, the Privacy Statement and/or the Cookie Policy and information contained on the Site at any time and without notice. Your continued use of any portion of the Site following notification or posting of such changes will constitute your acceptance of those changes.
2.3. Each time you use our Site you will be bound by the then current Terms and our Privacy Statement and Cookies Policy and you should review these each time you access and use our Site to satisfy yourself that you are happy with them.
3. Accessing our Site
3.1. Access to our Site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our Site without notice. We do not guarantee that our Site, or any content on it, will always be available or will be uninterrupted or error free. Any of the material on the Site may be out of date at any given time, and we are under no obligation to update such material. We reserve the right to withdraw or amend the service we provide on the Site without notice. We will not be liable if for any reason the Site is unavailable at any time or for any period.
3.2. You are responsible for making all arrangements necessary for you to have access to the Site. You are also responsible for ensuring that all persons who access the Site through your internet connection are aware of the Terms, and that they comply with them.
4. Who May Use the Services
4.1. You may use the Site only if you are:
4.1.1. a registered student at one of the Participating Institutions;
4.1.2. a legally employed member of staff at an approved registered charity (approved by UL or a Participating Institution) based in the Republic of Ireland (a "CSO"); or
4.1.3. a legally registered staff member at a Participating Institution with responsibility for managing the Site:
If you do not meet one of the above eligibility criteria please refrain from using the Site unless expressly permitted by us.
5. Intellectual Property Rights
5.1. We are the owner or the licensee of all intellectual property rights in the Site (except where specifically identified as third party content), and in the material published on it. Those works are protected by applicable intellectual property and other laws around the world. All such rights are reserved.
5.2. Except for the making of a hard copy print for your own personal use only or the use of others in your organisation (or downloading the material for your own personal use or the use of others in your organisation only provided that you retain all copyright and proprietary notices), the materials on this website may not be copied, reproduced, transmitted, distributed or displayed, by any means, without the express written consent of UL or the applicable Participating Institution.
5.3. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
5.4. Our status (and that of any identified contributors) as the authors of material on the Site must always be acknowledged.
5.5. You must not use any part of the materials on the Site for commercial purposes without obtaining a licence to do so from us or our licensors.
5.6. If you print off, copy or download any part of the Site in breach of these terms of use, your right to use the Site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
6. Your Account and Password
6.1. Please note that you will be required to accept our terms of use before you can proceed to register on the Site and create an account. We may suspend or terminate your account at any time.
6.2. If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.
6.3. It is important that you provide us with accurate, complete and up-to-date information for your account and you agree to update such information, as needed, to keep it accurate, complete and up-to-date. You are responsible for all activities that occur under your account, whether or not you are aware of them.
7. Information about you and your visits to the Site
7.1. We process information about you in accordance with our Privacy Statement and Cookies Policy. By using the Site, you consent to such processing and you warrant that all information provided by you is accurate and that you have the consent of all those whose personal data have been disclosed, for such processing of their personal data.
8. Volunteer Opportunities
8.1. It may not be possible in all cases to match students with volunteering opportunities in respect of which information is made available on the Site (or vice a versa).
8.2. In the event that any students using the Site (the "Volunteers") are matched with volunteering opportunities via the Site neither the UL nor any of the Participating Institutions shall have any responsibility, obligation or liability in respect of any volunteer works carried out pursuant to or in connection with such opportunities or any other communications between CSOs and students. CSOs offering volunteering opportunities via the Site and the Volunteers using the Site shall engage directly in relation to such opportunities or offerings. Without prejudice to the generality of the foregoing it is the responsibility of the applicable CSO to make sure that Volunteers are insured when taking part in a volunteer opportunity. By using the Site, you warrant that you agree to and will comply with this Section 8.
9. Provision of training
9.1. Any CSOs offering volunteering opportunities may require Volunteers to be trained in certain areas such as child protection, health and safety, first aid or otherwise and may require volunteers to be fully Garda vetted. In such cases it is the responsibility of the CSO, not the Participating Institutions and/or the UL to manage and advise Volunteers of any such requirements in advance of commencing a volunteering opportunity.
10. Use of the Site
10.1. You may use the Site only for lawful purposes. You may not use the Site: to copy, publish or send material which is illegal or unlawful, or material which could give rise to legal action under Irish and other applicable law. All material you copy, publish or send via the Site must not be defamatory, obscene, indecent, hateful, discriminatory or inflammatory; such material must not infringe any person’s intellectual property rights or rights of confidence, impinge upon any person’s privacy, or constitute incitement to commit a crime; further, material must not be misleading, deceptive, sexually explicit, threatening, abusive, harassing or menacing;
in any way that breaches any applicable local, national or international law or regulation or interferes with the rights of any third parties;
in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
for the purpose of harming or attempting to harm others, including minors, in any way;
to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam);
in any way that causes, or may cause, damage to the Site or impairment of the availability or accessibility of the Site; or
for any purposes related to marketing or promoting of volunteering opportunities or events except for areas specifically and expressly made available for the provision of information relating to volunteering opportunities in accordance with these Terms.
10.2. You may not collect or store any personal data available from the Site relating to users of the Site without their permission.
10.3. These content standards apply to any and all material which you contribute to the Site (“Contributions”).
11. Uploading content to the Site
11.1. Whenever you make use of a feature that allows you to upload content to the Site, or to make contact with other users of the Site, you must comply with these Terms and in particular, any Contributions must be accurate and comply with the provisions of Section 10.
11.2. You warrant that any such Contributions comply with these Terms, and you will be liable to us and indemnify us for any breach of that warranty. This means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.
11.3. Any content you upload to the Site will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your content, but you are required to grant us and other users of the Site a limited licence to use, store and copy that content and to distribute and make it available to third parties.
11.4. You hereby consent to the provision of your information to CSOs for the purposes described on the Site or otherwise in connection with a volunteer opportunity.
11.5. You are solely responsible for securing and backing up your content.
12. Viruses, hacking and other offences
12.1. You must not misuse the Site by knowingly introducing viruses, trojans, worms, logic bombs, keystroke loggers, spyware, adware or any other material which is malicious or technologically harmful or similar computer codes designed to adversely affect the operation of any computer software or hardware. You must not attempt to gain unauthorised access to the Site, the server on which the Site is stored or any server, computer or database connected to the Site. You must not attack the Site via a denial-of-service attack or a distributed denial-of service attack.
12.2. By breaching this provision, you may commit a criminal offence. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Site will cease immediately.
12.3. We do not guarantee that our Site will be secure or free from bugs or viruses.
12.4. We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Site or to your downloading of any material posted on it, or on any website linked to it.
13. Suspension and termination
13.1. We will determine, in our discretion, whether there has been a breach of the Terms through your use of our Site. When a breach of the Terms has occurred, we may take such action as we deem appropriate.
14. Linking to the Site
14.1. You may link to our Site via the home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. Any link to the Site must comply with the following conditions:
· You must not establish a link from any website that is not owned by you;
· You must not remove, distort, alter the size or appearance or otherwise use any trademarks or logos of the UL and/or a Participating Institution;
· The Site must not be framed on any other website, nor may you create a link to any part of the Site other than the homepage.
· You must not present any false information about UL, a Participating Institution and/or the Site;
· Any website from which you establish a link must not contain content that is distasteful, offensive or controversial, infringe any intellectual property rights or other rights of any other person and must comply with all applicable laws and regulations.
14.2. You agree to fully indemnify UL and the applicable Participating Institution for any loss of damage suffered by it for breach of this Section 14. We reserve the right to withdraw linking permission without notice.
15. Links from the Site
15.1. Where the Site contains links to other websites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those websites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them. If you do decide to access any of these third party websites you do so entirely at your own risk.
16. Our liability
16.1. The material displayed on the Site is provided without any guarantees, conditions or warranties as to its accuracy.
16.2. To the extent permitted by law, we, and third parties connected to us hereby expressly exclude:
· all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity;
· any liability for loss or damage incurred by any user in connection with the use, inability to use, or results of the use of our Site, any sites linked to it and any material posted on it; and
· any liability for any direct, special, indirect or consequential loss or damage incurred by any user in connection with the Site or in connection with the use, inability to use, or results of the use of the Site, any sites linked to it and any materials posted on it, including, without limitation any liability for loss of income or revenue; loss of business; loss of profits or contracts; loss of anticipated savings; loss of data; loss of goodwill; wasted management or office time; and for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.
16.3. Nothing in this Section 16 affects our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.
17. Account Information
17.1. It is up to you to review and amend your data and profile information regularly (e.g. student number, email address, year of study, mobile phone number etc.). You can update your details on your profile page. It is also important that you delete your profile or account (or notify a local coordinator to delete your profile on your behalf) once you are no longer a student of a Participating Institution or otherwise no longer meet one of the eligibility criteria set out in Section 4. Your profile/account information will be removed from the Site after a specified period, based on the date you first signed up to use the database.
18. Waiver
18.1. If we fail to insist upon strict performance of any of our obligations under any of these Terms, or if we fail to exercise any of the rights or remedies to which we are entitled under these Terms, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations. A waiver by us of any default shall not constitute a waiver of any subsequent default. No waiver by us of any of your obligations under these Terms shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing.
19. Jurisdiction and applicable law
19.1. The Irish courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to the Site although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.
19.2. These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of Ireland.
20. Severability
20.1. If any of these Terms are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
